I asked the other day about a situation in which I received a minor in consumption citation. The police showed up at the apartment with a noise complaint and introduced themselves as "pizza delivery guys". They then entered the apartment without the consent of the renter (not sure if they had the manager's permission), and started handing out citations. My first question is can they legally hand out citations after lying to the citizens about their identity? Also, the officer who wrote mine up completely screwed up the form. He wrote my street address as in Grand Forks, when I specifically told him I lived in Fargo. That street address doesn't even exist in Grand Forks. He got the day of the citation wrong (he wrote Saturday....it was 12:10 am on Sunday). I have also heard that they are required to round the breathalyzer result to the second decimal place. He wrote the entire three decimals on my citation (0.072 as opposed to 0.07). This leads me to my main question, whether or not they were acting legally in the first place, does his complete lack of attention to detail on the citation make it void? In response to Logic316: I know you can get a pretty good guess at someone's age by looking at them, but I don't think (by law) police officers can just assume you are underage and enter the premises. You can't honestly tell me that you can tell the difference between a 19 year old and a 21 year old just by looking at them.... Read More »
